Leinster Regiment Cap Badge

Due to Association now falling within the mandates of EU law that apply to the Association's coach trips to France and Flanders, the officers of the Association have considered and support a proposal to revise the Constitution of the Association. This proposal must now be considered by the members of the Association and a vote on its acceptance will take place at an Extraordinary General Meeting to be held on the 12 June The Leinster Arms Public House, Leinster Terrace, Bayswater, London W2; the meeting to commence at 12 noon.

Background: The EU introduced a mandate governing the protection of customers who travel on an organised package coach tour that includes transport and accommodation. The UK Government accepted the EU Law and incorporated it into UK law; within that legislation clubs, societies, schools and associations who organise an inclusive package tour have been designated Tour Operators. The Association's annual trip to France/Flanders and other events in which the Association may engage imposes upon the Association the requirement to comply with that legislation. As part of the Association's officers evaluation of what needed to be done the Officers determined that the existing Association's constitution did not empower the Association's officers to make the appropriate arrangements that enabled the Association to comply with the law; in fact the existing Constitution did not provide the necessary authorities for the Officers to perform many of the necessary functions that enable the Association to run as smoothly as it does.

Why a new Constitution?
In addition to enabling the Association to comply with current legislation, the proposed new constitution brings the Prince of Wales's Leinster Regiment (Royal Canadians) into line with the majority of duly constituted organisations through the adoption of formal agreements relating to the creation, the principles of operation and a set of members rules. These will be referred to as the Memorandum of the Association, The Articles of the Association and the Bye Laws.
By adopting the revised Constitution the legal position of the Association is confirmed, the necessary authorities that the Officers and committee need to administer the Association, and more importantly the rights of the Association's members are safeguarded.

If the Association is to continue to function in a way that guarantees the rights of its members the Association's constitution should be revised. If the Association is to continue to offer the annual coach trip to France and Flanders the Association's constitution must be revised.

The Proposal
The Officers of the Association wish the Association's members to consider and confirm, at the Extraordinary General meeting to be held on the 12 June at the Leinster Arms, the adoption of a new revised and updated Constitution that formalises the existence of the Association, provides to the Officers the necessary authority to administer he Association and provides the necessary safeguards for the Association's member's rights.
